Post-market monitoring

Providers of high-risk systems must actively collect, document and analyse operational performance data throughout the system's lifetime. Applicability date is contested — commentary published in H1 2026 largely predates or under-weights Regulation (EU) 2026/1744 (the Digital Omnibus on AI, in force 27 July 2026), which deferred the Annex III high-risk regime to 2 December 2027. Serious incident reporting

Providers must report serious incidents involving a high-risk system to the relevant market surveillance authority. Same contested-applicability-date note as Art. 72 above — the deferral changed deadlines, not substance; build the reporting process regardless of which reading applies to your system.
